This FOOD TRUCK LEASE AGREEMENT (hereinafter referred to as the “Agreement") made and entered into this [Document.CreatedDate] by and between:

Rent/Payment

The rent to be paid for this Lease Agreement shall amount to $_______, payable on the ______ day of every month. The first full rent payment under this Lease Agreement is due on the ______ day of ____________, 20____.

In the case of late payments, a $(amount) per day penalty shall be imposed and shall not be waived. Rent is considered late when it is not paid within (insert amount) day(s) after the due date.

Specified area

Lessee agrees to use the Food Truck for commercial purposes only within (area) as its territory during the term of this Agreement.

Responsibilities

Lessee represents and warrants that it is appropriately licensed and certified to operate a food truck and offer food services and that it will maintain all proper licenses, certificates, and permits required during the period of this agreement. Lessee also agrees that the:

A. Driver(s) will maintain proper driver’s license and other certificates or permits as required.

B. Employees operating in the city premise shall be dressed in proper uniforms or any other suitable clothing as discussed with Lessor.

C. Fee or rates charged by the Lessee for its food services shall be as per fair market price.

D. Comply with all relevant federal, state, and local guidelines concerning food and safety.

E. NOT participate in prohibited advertising on the Food Truck

Rules and regulations for food trucks can be altered per mutual agreement. As a good practice, it is recommended to create a separate document to dive into a broader range of topics in a more comprehensive manner. For example, if you want to list out what kinds of advertising practices are prohibited, that should be done in the supplemental document, not in this contract.

Security Deposit

As a part of this Agreement, the Lessee shall deposit a sum of $(amount) as a security deposit for any damage caused to the Food Truck during the term hereof. Security deposit is required from the Lessee at the execution of this agreement. Within 30 days of the termination of this Agreement, the Lessor will refund to the Lessee the entirety of the security deposit funds, less any funds that have been retained to cover the amount due to the Lessor under this agreement.

Modifications to the food truck

The Lessee is not permitted to paint or otherwise modify or materially alter the Food Truck without the prior written consent of the Lessor.

Remove this clause if the liability to pay for insurance coverage lies solely on the Lessor. Subsequently, edit this clause as needed.

Insurance coverage

During the term of the Agreement and until the return of the Food Truck, it is the responsibility of the Lessee to maintain insurance as acceptable to the Lessor. Lessee shall adhere to the minimum coverages as applicable.

A. Theft, fire, and collision coverage each for the implied cash value of the vehicle with a maximum deductible of $(amount);

B. Liability insurance for $(amount) per person, $(amount) in case of bodily injury or death, and $(amount) in case of property damage.

Termination

Lessee shall have the right to terminate this Agreement at any point in time by informing the Lessor with written notice at least (days) before. Additionally, the Lessee will be liable to pay an early termination fee of $(amount).

During the notice period, the responsibility to pay the rent will be on the Lessee.

In the case, the Lessee is unable to comply with the terms and conditions of the agreement, misrepresents any fact on the rental application, or the rental payment has been delayed beyond the (number) business day of the calendar month, then this Agreement shall be terminated by the Lessor.

However, the Lessor shall have to provide the Lessee with appropriate notice and adhere to the procedures required as per the law of the (state).

Lessee shall not have the right to terminate the Agreement early.
